Procedure for Muzzle Orders 

Municipal Law Enforcement Officers may declare that a dog is dangerous upon receipt of a signed Declaration in the form attached hereto as “Schedule B”, attested to by a witness who actually saw the alleged dangerous dog bite a person or a domestic animal.  The Declaration must identify the dog, the dog owner and dog owner’s address, and provide details of the incident and be delivered to: Municipal Law Enforcement Division, Administration Office, 100 Dissette St., P.O. Box 100, Units 7 & 8, Bradford, ON  L3Z 2A7.

Issuance of a Muzzle Order 

In the event the declaration is found to have warrant, an Order to Muzzle will be issued and forwarded to the dog owner by registered mail.

Appeal of a Muzzle Order - Charge for Appeal to recover administration and overhead costs $125.00

Where a dog has been declared dangerous by the Municipal Law Enforcement Officer and a Muzzle Order has been issued, the owner of the dog may apply for a Hearing to Appeal the Notice.

An Application for Appeal and Request Hearing with respect to the Notice to Muzzle shall be in the form attached hereto as “Schedule D”, stating the reason(s) for the Appeal, accompanied by a fee in the amount of $125.00 (cash, cheque made payable to the Town of Bradford West Gwillimbury, debit or Visa/Mastercard), and delivered to:  Secretary, Appeals Committee, Administration Office, 100 Dissette St., P.O. Box 100, Units 7 & 8, Bradford, ON  L3Z 2A7.

Hearing

Upon receipt of an Appeal and Request for Hearing from an owner of the alleged dangerous dog, a meeting shall be convened of the Appeals Committee and shall give the owner of the dog and the person who saw the alleged dangerous dog bite, written notice of the date, time and location of the Hearing.

The applicant and any other interested person(s) may appear at the Hearing and present oral or written evidence relating to the dog.

The Appeal Committee, upon hearing the evidence may confirm the Notice to Muzzle, or exempt the owner of the dog from any of the muzzling, restraining or leashing requirements, or may dispose of an Appeal by Consent Order.

The decision of the appeal Committee is final and binding.
